Course Description

Public law, also known as administrative law, governs and regulates public sector bodies, ensuring they act in a way which is legal, reasonable, and fair.  An awareness and understanding of the key legal principles that apply to public administration and the delivery of public services is central for all public servants, and critical when it comes to dealing with legal challenges.

This course will take you through an informative overview of judicial review litigation, the core principles of public sector law, contract law, and will analyse real life case studies in which judicial review arises, with an emphasis on how litigation can be avoided.

  • Introduction to Judicial Review and the Courts role as a 'watch dog'
  • Locus standi and 'public' requirement / the Geoghegan principles
  • Contract Law in the Public Sector– common challenges
  • Overview of judicial review litigation:
    • Leave stage
    • Statement of grounds/ statement of opposition
  • Core principles:
    • Fair procedures
    • Obligation to give reasons
    • Bias & prejudgment
    • Legitimate expectation
  • Case studies and group discussion based on concluded JR decisions
    • Analysing real-life cases and legal challenges faced by public sector organisations
