Course Description

This course will focus on the recent Planning and Development Act 2024 with particular emphasis on environmental considerations necessary when applying for planning in Ireland. This course will highlight existing legal and regulatory frameworks, provide direction in relation to application processes and considerations, and use recent case law, evolving EU law and upcoming issues, to provide greater context when faced with considering this Act. This course act as a necessary tool for you to leave with a greater understanding of the legal and regulatory frameworks necessary to your project, where to find them and how to interpret them.

  • Existing Legal and Regulatory Frameworks –Climate Action Plan 2024, National Marine Planning Framework, Marine Area Planning Act 2021
  • Relevant Changes under the Planning and Development Act 2024
  • Interpretation of Terminology under the Act
  • Caselaw and Evolving EU Law – Coolglass vs ABP, RED III
  • Overview of the Planning and Development Act – What chapters apply to you?
  • Part 4 Chapter 4 Development – Planning Applications and Strategic Infrastructure Development
  • The role of An Bord Pleanála – The Commission
  • Necessary Developer Criteria – Powers to Develop s.85(1) & s85(2)
  • Pre-Application Consultation (PAC)
  • Application timelines, transition periods, life expectancy of projects
  • Project Definition and Flexibility Opinions – Procurement Requirements, Renewable Energy Grey Areas, Conditions attached to Ch4 permissions
  • Current Status and provisions of Appropriate Assessment of Plans and Developments and Environmental Impact Assessment of Developments
  • Relevant considerations of planning authorities and ABP including biodiversity strategies, climate action plan and low carbon development act.
  • Bringing considerations to the attention of planning authorities – the Developers role in planning protection
  • Upcoming Issues to consider

Who Should Attend

This course has been designed for anyone who may have involvement or need make considerations in regard to the planning and development act including but not limited to planning officers, engineers, directors, solicitors, legal, surveyors, contract managers, ecologists, environmental consultants, developers, land managers, stakeholders and stakeholder managers, project managers.

Certification

On completion of this one-day training course, you will receive your Certificate of Attendance. Please note certificates are issued at the close of the training course to participants on completion of the course.

Cost

An ‘Early Bird’ discounted rate of €535 is currently available. This training course normal rate is €635. Places are limited and are allocated on a first come first served basis.
